ROBERT I. EBER, Attorney and Counselor-at-Law [ HOME ]

DISCLAIMER
The communications revolution fostered by the Internet has far outpaced the development of rules that govern the lawyers' relationships and with our clients and others. This has left us in the ironic position of having to react more quickly than we otherwise might just to protect ourselves from real or perceived dangers. Hence, the birth and nurturing of the Web page disclaimer. Actually, the Internet does raise several legitimate and interesting issues that need to be addressed in the context of traditional ethical rules. It is in that context that I ask you that you review the following statements.

Attorney-client relationships and communications.
The information I provide on my Internet site is offered for informational purposes only; it is not offered as and does not constitute legal advice, whether you are a resident of the State New York, where I am licensed to practice, or elsewhere. The application and impact of relevant laws will vary from jurisdiction to jurisdiction, and you should seek professional counsel as to any impact such laws have on you. Any electronic communication between you and my firm is not secure, will not be privileged or confidential, and may be disclosed to other persons. Therefore, you should not send any e-mail to me that contains confidential or sensitive information. Transmission of any information between us is not intended to create, and receipt does not constitute, an attorney-client relationship.

Warranties and liability disclaimers.
This language may remind you of the licenses that are found on software packages or as part of that "Agreement" that you always acknowledge by pressing the "I agree" button so that you can continue to install the software. The principle is the same. There are federal and state warranty statutes - some of which can be found on this site - that may raise issues with respect to the delivery of information via the Web. And there may be some who do not understand the vagaries of the Internet. Accordingly, my firm disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. Specifically, but without limitation, my firm does not warrant that: (i) the information on this site is correct, accurate or reliable; (ii) the functions contained on this site will be uninterrupted or error-free; or (iii) defects will be corrected, or that this site or the server that makes it available are free of viruses or other harmful components. Under no circumstances shall the firm be liable for any damages, including direct, incidental, special, consequential or exemplary damages that result from the use of, or the inability to use, this site or the information contained on this site, even if the firm has been advised of the possibility of such damages.

The issue of links to other sites.
This site contains many links to non-firm sites. I provide these links to you only as a convenience, and to foster further understanding of many of the issues that we deal with every day. Such linked sites are not under my control and I am not responsible for the contents of any linked site, or any link contained in a linked site. Nor can I be responsible for continually updating those links. The inclusion of any link does not imply my endorsement of the site, nor can I have any responsibility for information which is referenced by or linked to this site. Finally, I freely grant permission to anyone wishing to link to this site without misrepresentation and will gladly remove any link from this site upon request from the linked entity
